The Bail Process in South Bay, California

What is a bail bond?

A bail bond, or a surety bond, is a contract between a licensed bail agent from the given state and the signer or cosigners. It guarantees that a defendant will appear for all scheduled court appearances. When a person fails to appear, or "skips" after signing the contract, the signers of the contract are held accountable for paying the full amount of the bond.

If your loved one has been placed under arrest and is currently in jail and you plan to post bail, we at Adelante Bail Bonds strongly urge you to first learn your rights and options. Signing a bail bond is a heavy responsibility, and ensuring that you choose the right agency is even more imperative. At our office, the South Bay bail bond agents can help you to understand the process of bail and your responsibilities as a bail indemnitor. You may call our office today to speak with a license bondsman about your situation and find out all the facts for free.

Getting Your South Bay Bail Bond Approved

An interview will be conducted to determine if you are eligible and to collect information. While most bondsmen require collateral from their customers, we will treat you as if you are family and try to create a contract in which collateral will not be necessary. The process is tailored to fit your specific needs and can be done in a matter of minutes, as we know that time is of the essence in your loved one's case.

Questions, including the nature of the charges, when the arrest took place, the amount of time you have known the defendant, if you and the defendant are currently employed and if so for how long and if you and the defendant are homeowners, will all be asked in order to quickly move along to the approval process.

The paperwork in the process includes a bail bond application, Indemnity Agreement and a receipt. We can come to you or simply send the paperwork by fax or email. After all of your paperwork is finalized, one of our licensed agents will file the bond (commonly referred to as "posting bail") with the jail in which your loved one is currently being held, triggering the release of this defendant.

Our office will complete your paperwork from start to finish, having the bail posted in approximately one to two hours. However, all jails function differently in the way that they process the bonds, so it may take longer on their end. The customer who has signed the Indemnity Agreement is then charged a bail bond fee, which is usually around 10% of the full bail amount as mandated by state law.

What happens if the defendant is not bailed out?

If your loved one is not bailed out or otherwise released from jail for any reason, they will stay there until arraignment or even until after the matter has been entirely resolved in court. By posting bail, you are allowing your loved one to find proper and qualified legal services in order to obtain the best defense.

The Cost of South Bay Bail Bonds

In the state of California, state law regulates the fees on bail bonds. This means that the rates are not negotiable and are enforced by the law. Here, we have a fee that requires the indemnitor to pay 10% of the bail. For example, if bail is set at $50,000, the indemnitor is responsible for $5,000. There are no taxes for these types of bonds.

Our office offers a variety of payment options, including Visa, Mastercard, American Express and Discover Card, cash and no cost financing for qualified customers.
